When is a Building Permit required
A building permit is generally required for all works associated with a commercial building unless exempt under Schedule 3, Building Regulations 2018. However, due to the vast requirements relevant to commercial buildings, even internal fit outs that will not result in structural alterations will require a building permit. It is important to always confirm with your local council or a private building surveyor prior to commencing any building work pertaining to a commercial building to avoid non-compliance and legal action being incurred. This extends to full or partial demolition of a commercial building.

Council and Relevant Authority Approvals
(Planning Permit/Report & Consents)
In addition to a building permit, a planning permit will in most cases be required from your local council depending on the planning zone and overlays in force on your allotment. If a planning permit is required, a building permit cannot be issued without the planning permit being issued. Watershed Building Consultants can assist by reviewing your documentation provided with your application and determine whether a planning permit is triggered. Alternatively, you can seek written advice from your local councils planning department to confirm if you require a planning permit for your project.
A report and consent refer to consents granted by the council or other relevant authority as required under the Building Regulations 2018. For example, consent to building over an easement or installing or altering a septic tank system.
Carrying out building works without the proper permits and consents from council can result in fines or even require the removal of the structure. Watershed Building Consultants can liaise with your local council to clarify the permit requirements and guide you in your applications for approval before construction begins.
Mandatory Documentation for Renovations
To determine compliance with the relevant building legislation and the NCC, specific documentation will be required to be submitted to the relevant building surveyor. The more information you can compile prior to lodging your application will expedite the process and limit the extent of any further information requested once your project is assessed by the relevant building surveyor.
Commercial projects are quite complex and the amount of documentation that may be required is significantly dependent on the nature of the building work and various other factors. Generally, we will need several important documents to be submitted to ensure an accurate and timely review of your documentation:
- Completed application form (this can be completed online).
- Completed appointment of building surveyor form.
- Proof of ownership (Certificate of title and/or Notice of Acquisition).
- Planning Permit and endorsed plans (if required) – please contact your local council to ascertain if this is required. We also let you know if this is required once we assess the project.
- Property information from council (termite, flooding and designated land information) – we can apply for this on your behalf.
- Architectural design (working drawings) which outlines the proposed works, fire services, electrical and mechanical design.
- Structural design, computations and certificate of compliance for the proposed work.
- Independent consultants report as applicable to the project (i.e. geotechnical, energy efficiency consultant, access consultant, fire engineer, acoustic reports)
- Bush fire attack level (BAL) assessment – if within a designated bush fire area.
Payment of the building permit fee will be payable once the building permit application has been reviewed by the building surveyor.
Navigating the Permit Application Process
Once you have the above documentation in order, you can apply for a building permit with Watershed Building Consultants by either submitting your application in person at one of our office locations or via one of our emails [email protected] or [email protected]. To get started, you can request a quote for your building permit online.
Once submitted, we will notify the council of our appointment as your relevant building surveyor and your project will be assigned to one of our building surveyors to commence their initial assessment. Initial assessments are usually completed between 10 and 15 business days of receipt. If the building surveyor requires any additional information or modifications to the design to achieve compliance, they’ll send you a request for further information via email. Don’t worry if further information is requested, it’s a common part of the process.
Once all required and requested documentation is received and payment is made, your building permit can be issued and building works can commence.

This will include compliance certificates from the tradesman that carried out building work and additional consents from the council or other relevant authorities as required.
